Recently an ASU member on maternity leave at Mission Australia sought advice from our Member Assistance Line when Mission Australia tried to make her redundant without any consultation while she was on parental leave.
Our Industrial Officers took the case to the Fair Work Commission (FWC). The FWC accepted our arguments that Mission Australia had not engaged in meaningful consultation and had not done all it could have to make a reasonable effort to ensure our member could be redeployed into another job at Mission Australia.
We argued that our member was at a disadvantage because she was made redundant while on parental leave and it would be more difficult for her to secure full-time work while she was on leave. We argued that it was reasonable to delay or postpone the redeployment period because it would give her a better chance of staying with Mission Australia.
The case resulted in Mission Australia reaching a confidential settlement with the ASU member involved.
