The application to approve the RailCorp EBA was conditionally approved today. Members voted over 95% in favour of endorsing the proposed Agreement and while it does not get everything we want, it provides significant job protection for the next four years. The hearing, at 10am at Fair Work Australia before Commissioner Cambridge, went through all the legal requirements in approving the Agreement.
RailCorp made four undertakings to address issues that were overlooked in the drafting of the Agreement. These include ensuring that safe work is provided to pregnant women, ensuring that adoption leave is available to men and women and fixing a situation where the pay rates of two classifications (that nobody is employed under) were updated correctly.
Commissioner Cambridge approved the Agreement on the condition that RailCorp provide a signed copy of the undertakings this afternoon. Once this has happened, the Agreement will come into force in 7 days. Members should expect the 4% pay increase to be applied to the first pay after 7 days and should receive back pay in the pay after that.
