Capricious Behaviour? On November 25 Mission Australia’s management representatives emailed your bargaining agents (including the ASU) to advise us that they had determined that face-to-face negotiations for your enterprise agreement set for December 10 and 11 would be cancelled and instead held by teleconference. When we talk about Union being the voice of members that certainly does not mean we believe that management should take that literally and not sit at the table with us as we fight for the pay and conditions of all!

Dear Jo,
I refer to your Corrospondence dated 1 December 2009 in which you raised objections to conducting negotiations on 10 and 11 December by a combination of face to face and teleconference (for those bargaining representatives not located in Sydney).

Dear Fiona,
GOOD FAITH BARGAINING: BAD FAITH
We refer to the good faith bargaining that commenced in September 2009. We are concerned that you are not meeting the good faith bargaining requirement set out in section 228(e) of the Fair Work Act, because you refusing to meet face to face.
