Canon Members Say NO to GPS and KPIs
Next Wednesday your NCC representatives will meet with Canon management. Top on the agenda are the attempts by Canon to force the installation of GPS into vehicles and draft 2012 Technicians goals (as created by management).
GPS
Most Technicians would be aware that Canon management want to put GPS into vehicles. For Technicians based in New South Wales, Victoria and West Australia each state’s Surveillance Devices Act means that Canon must get the express or implied consent from you before Canon can attempt to install any tracking devices, including GPS. BUT once you give Canon express or implied consent, you can never revoke it.
In New South Wales the law states: Surveillance Devices Act 2007 (SECT 9(1)(a) - Prohibition on installation, use and maintenance of tracking devices) : “A person must not knowingly install, use or maintain a tracking device to determine the geographical location of a person-without the express or implied consent of that person, or an object-without the express or implied consent of a person in lawful possession or having lawful control of that object. Maximum penalty: 500 penalty units (in the case of a corporation) or 100 penalty units or 5 years imprisonment, or both (in any other case).” http://www.austlii.edu.au/au/legis/nsw/consol_act/sda2007210/s9.html
For NSW technicians the law is on our side. For Canon to install the device management must get your consent. So just don’t give it. However QLD and SA technicians aren’t covered by such laws. There are similar laws but not as strong as in other states. This means that we must remain vigilant for all members. The resolution and petition of members is clear, members do not want the 24/7 monitoring and pervasive intrusion of a GPS installed in their vehicles- no matter which state you work in.
Draft 2012 Technicians Goals
A “draft 2012 Technicians Goals’’ has been circulated by Canon management. Under clause 34 of the Canon Australia Pty ltd (Technical Consultants) Collective Agreement 2009 the balanced scorecard is decided each year. This is not part of the balanced scorecard and the Union will get clarification from Canon about what purpose the draft 2012 Technicians Goals is meant to serve. The Union will not be agreeing to the draft 2012 Technicians Goals in its current format.
